EAST KENT BMX CLUB CONSTITUTION

1. Name

1.1– The club shall be called “East Kent BMX Club” and shall be affil­i­ated to British Cycling.

2. Aims and Objectives

The aims and objec­tives of the club will be:

2.1– To orga­nize and pro­mote BMX racing

2.2– To offer coach­ing and com­pet­i­tive oppor­tu­ni­ties in BMX cycling

2.3– To pro­mote the Club and encour­age coach­ing within the local and regional community

2.4– To man­age Club facilities

2.5– To ensure a duty of care to all members

2.6– To ensure that all present and future mem­bers receive fair and equal treatment

3. Mem­ber­ship

3.1– Mem­ber­ship will con­sist of offi­cers and full members

3.2– All mem­bers will be sub­ject to the reg­u­la­tions of the con­sti­tu­tion and by join­ing will be deemed to accept these reg­u­la­tions and code of conduct

3.3– Mem­ber­ship fees will be set annu­ally and agreed by the man­age­ment committee

3.4– Mem­ber­ship fees are to be paid on the 1st of Novem­ber annually

3.5– No mem­bers except Club Sec­re­taries shall be allowed to send any cor­re­spon­dence, or make any deci­sions regard­ing the club with­out per­mis­sion of the committee

3.6– Mem­bers shall be encour­aged to take British Cycling membership

4. Club Officers/Committee

4.1– The club will be man­aged by a com­mit­tee com­pris­ing of the fol­low­ing Officials:

                      Chairman

                      Club Secretary

                      Treasurer

                      And any other offi­cials the Club con­sid­ers necessary

4.2– Offi­cers will be elected annu­ally at the Clubs’ Annual Gen­eral Meeting

4.3– The Com­mit­tee will be respon­si­ble for adopt­ing new pol­icy, codes of con­duct and rules that may affect the club

4.4– The Com­mit­tee will be respon­si­ble for dis­ci­pli­nary hear­ings of mem­bers who infringe the Clubs rules, reg­u­la­tions or constitution

4.5– The Com­mit­tee shall meet at min­i­mum once a month to trans­act the Club busi­ness, with 3 Offi­cials to form a quorum

4.6– Any Offi­cial absent for three con­sec­u­tive meet­ings with­out obtain­ing leave of absence shall be deemed to have resigned, and the Com­mit­tee shall fill the vacancy

5. Finances

5.1– All club monies will be banked in an account held in the name of the club

5.2– The Club Trea­surer will be respon­si­ble for the finances of the club

5.3– The finan­cial year of the club will end on the 31st of March

5.4– An audited state­ment of annual accounts will be pre­sented by the Trea­surer at the Annual Gen­eral Meeting

6. Annual Gen­eral Meeting

6.1– Notice of the Annual Gen­eral Meet­ing (AGM) will be given by the Club Sec­re­tary. Not less than 21 days notice is to be given to all members

6.2– Nom­i­na­tions of Offi­cers for the Com­mit­tee will be sent to the sec­re­tary prior to the AGM

6.3– Elec­tion of Offi­cers will take place at the AGM

6.4– All mem­bers have a right to vote at the AGM

6.5– The quo­rum for AGMs will be 25% of membership

6.6– The Com­mit­tee has the right to call Extra­or­di­nary Gen­eral Meet­ings (EGMs) out­side the AGM. Pro­ce­dures for EGMs will be the same as for the AGM

7. Dis­ci­pline and Appeals

7.1– All com­plaints regard­ing the behav­ior of mem­bers should be sub­mit­ted in writ­ing to the Secretary

7.2– The Com­mit­tee shall meet to hear com­plaints within 21 days of a com­plaint being lodged. The Com­mit­tee has the power to take appro­pri­ate dis­ci­pli­nary action includ­ing the ter­mi­na­tion of membership

7.3– The out­come of a dis­ci­pli­nary hear­ing should be in writ­ing to the per­son who lodged the com­plaint and the mem­ber against who the com­plaint was lodged within 21 days of the hearing

7.4– There will be the right of appeal to the Com­mit­tee fol­low­ing dis­ci­pli­nary action being announced

8. Equal­ity Policy

8.1– The Club’s Equal­ity Pol­icy is con­tained in a sep­a­rate doc­u­ment that appears as a sup­ple­ment to this Constitution

9. Dis­so­lu­tion

9.1– A res­o­lu­tion to dis­solve the Club can only be passed at an AGM or EGM through a major­ity vote of the membership

9.2– In the event of dis­so­lu­tion, any assets of the Club that remain will be passed to other local clubs with sim­i­lar objec­tives to those of the club

10. Amend­ments to the Constitution

10.1– The con­sti­tu­tion will only be changed through agree­ment by major­ity vote at any AGM or EGM
