EAST KENT BMX CLUB CONSTITUTION
1. Name
1.1– The club shall be called “East Kent BMX Club” and shall be affiliated to British Cycling.
2. Aims and Objectives
The aims and objectives of the club will be:
2.1– To organize and promote BMX racing
2.2– To offer coaching and competitive opportunities in BMX cycling
2.3– To promote the Club and encourage coaching within the local and regional community
2.4– To manage Club facilities
2.5– To ensure a duty of care to all members
2.6– To ensure that all present and future members receive fair and equal treatment
3. Membership
3.1– Membership will consist of officers and full members
3.2– All members will be subject to the regulations of the constitution and by joining will be deemed to accept these regulations and code of conduct
3.3– Membership fees will be set annually and agreed by the management committee
3.4– Membership fees are to be paid on the 1st of November annually
3.5– No members except Club Secretaries shall be allowed to send any correspondence, or make any decisions regarding the club without permission of the committee
3.6– Members shall be encouraged to take British Cycling membership
4. Club Officers/Committee
4.1– The club will be managed by a committee comprising of the following Officials:
Chairman
Club Secretary
Treasurer
And any other officials the Club considers necessary
4.2– Officers will be elected annually at the Clubs’ Annual General Meeting
4.3– The Committee will be responsible for adopting new policy, codes of conduct and rules that may affect the club
4.4– The Committee will be responsible for disciplinary hearings of members who infringe the Clubs rules, regulations or constitution
4.5– The Committee shall meet at minimum once a month to transact the Club business, with 3 Officials to form a quorum
4.6– Any Official absent for three consecutive meetings without obtaining leave of absence shall be deemed to have resigned, and the Committee shall fill the vacancy
5. Finances
5.1– All club monies will be banked in an account held in the name of the club
5.2– The Club Treasurer will be responsible for the finances of the club
5.3– The financial year of the club will end on the 31st of March
5.4– An audited statement of annual accounts will be presented by the Treasurer at the Annual General Meeting
6. Annual General Meeting
6.1– Notice of the Annual General Meeting (AGM) will be given by the Club Secretary. Not less than 21 days notice is to be given to all members
6.2– Nominations of Officers for the Committee will be sent to the secretary prior to the AGM
6.3– Election of Officers will take place at the AGM
6.4– All members have a right to vote at the AGM
6.5– The quorum for AGMs will be 25% of membership
6.6– The Committee has the right to call Extraordinary General Meetings (EGMs) outside the AGM. Procedures for EGMs will be the same as for the AGM
7. Discipline and Appeals
7.1– All complaints regarding the behavior of members should be submitted in writing to the Secretary
7.2– The Committee shall meet to hear complaints within 21 days of a complaint being lodged. The Committee has the power to take appropriate disciplinary action including the termination of membership
7.3– The outcome of a disciplinary hearing should be in writing to the person who lodged the complaint and the member against who the complaint was lodged within 21 days of the hearing
7.4– There will be the right of appeal to the Committee following disciplinary action being announced
8. Equality Policy
8.1– The Club’s Equality Policy is contained in a separate document that appears as a supplement to this Constitution
9. Dissolution
9.1– A resolution to dissolve the Club can only be passed at an AGM or EGM through a majority vote of the membership
9.2– In the event of dissolution, any assets of the Club that remain will be passed to other local clubs with similar objectives to those of the club
10. Amendments to the Constitution
10.1– The constitution will only be changed through agreement by majority vote at any AGM or EGM
